Yuma Asphalt Paving provides asphalt paving, sealcoating, crack sealing, pothole repair, parking lot maintenance, grading, drainage, and related services for residential and commercial properties inYuma, AZ and the surrounding service area.
The scope of any specific project is defined by the written estimate or contract provided to the customer prior to work beginning. Work not described in the written estimate is outside the scope of the agreed project and may incur additional charges.
All estimates are provided in writing and are valid for 30 days from the date issued unless otherwise stated. Estimates are based on the condition of the site and materials visible at the time of assessment. If site conditions differ materially from what was visible during the estimate visit, adjusted pricing may apply and will be communicated to the customer before work proceeds.
Asphalt material costs are tied to petroleum prices and can fluctuate. If significant time passes between an estimate and a project start date, we may need to reconfirm pricing based on current material costs. We will notify you of any changes before work begins.
Project dates are scheduled upon acceptance of a written estimate. We make reasonable efforts to complete work on the agreed date. Dates may be adjusted due to weather, material delays, or other conditions outside our control. We will notify you of any schedule changes as promptly as possible.
If you need to cancel or reschedule a project, please notify us at least 48 hours in advance. Late cancellations may result in a fee if materials have been ordered or equipment has been staged for your job.
We reserve the right to decline or reschedule any project at our discretion, including cases where weather or site conditions would compromise the quality of the work.
Before work begins, the customer is responsible for:
Yuma Asphalt Paving is not responsible for damage to unmarked underground utilities, irrigation systems, or other subsurface features that were not disclosed prior to work beginning.
Payment terms are outlined in the written estimate or contract provided to the customer. For most residential projects, payment is due upon completion of work. For larger commercial projects, a deposit may be required to secure materials and scheduling.
Accepted payment methods will be communicated at the time of estimate. Invoices not paid within the agreed timeframe may be subject to a late fee of 1.5 percent per month on the outstanding balance, or the maximum rate allowed by Arizona law, whichever is less.
In the event of non-payment, Yuma Asphalt Paving reserves the right to pursue all remedies available under Arizona law, including but not limited to the filing of a mechanics lien on the property.
Yuma Asphalt Paving warrants that work will be completed in a professional manner consistent with industry standards. Any specific warranty terms will be stated in the written estimate or contract. Where no specific warranty period is stated, our workmanship warranty covers defects in materials and installation for one year from the date of project completion, subject to the exclusions below.

Except as expressly stated in writing, all other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, are disclaimed to the fullest extent permitted by applicable law.
To the maximum extent permitted by applicable law, Yuma Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to any service engagement or use of this website, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from a service project shall not exceed the total amount paid by you to Yuma Asphalt Paving for that specific project.

Any legal proceedings that cannot be resolved through mediation shall be brought in the courts of Yuma County, Arizona, and you consent to the personal jurisdiction of those courts.
These terms and conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these terms or from any service engagement shall be subject to the exclusive jurisdiction of the courts of Yuma County, Arizona.
We reserve the right to update or modify these terms at any time. Changes will take effect immediately upon posting to this page, with the effective date updated accordingly. Your continued use of this website or engagement with our services after changes are posted constitutes acceptance of the revised terms.
